CONSUMER RIGHTS - WITHDRAWAL - CANCELLATION RETURN CONDITIONS

 

GENERAL:

​

  1. When you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchase.

  3. Shipping costs, such as the product shipment fee, will be paid by the buyers.

  4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers can terminate the contract.

  5. The purchased product must be delivered complete, in accordance with the qualities specified in the order, and with any accompanying documents such as a warranty certificate and user manual.

  6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing of this situation within 3 days from the time they become aware of it. The total amount must be refunded to the buyer within 14 days.

 

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

​

  1. If the buyer does not pay the price of the product purchased or cancels it in bank records, the seller's obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

​

  1. After the product is delivered, if it is determined that the credit card with which the buyer made the payment was unjustly used by unauthorized persons and the price of the sold product is not paid to the seller by the related bank or financial institution, the buyer must return the product subject to the contract to the SELLER within 3 days. The return shipping cost will be borne by the SELLER.

 

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If force majeure reasons that the seller cannot foresee occur and the product cannot be delivered on time, the situation is reported to the buyer. The buyer can request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the buyer cancels the order; if the payment was made in cash, this fee is paid to them in cash within 14 days from the cancellation. If the buyer made the payment with a credit card and cancels, the product price is refunded to the bank within 14 days from this cancellation, but it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

OBLIGATION OF THE BUYER TO CHECK THE PRODUCT:

​

  1. The buyer shall inspect the product/service subject to the contract before accepting delivery; they will not accept goods/services that are dented, broken, with torn packaging, etc., or that are damaged or defective from the courier company. It will be accepted that the goods/service received are undamaged and intact. The BUYER is obliged to protect the goods/service carefully after delivery. If the right of withdrawal is to be exercised, the goods/service should not be used. The invoice should also be returned with the product.

 

RIGHT OF WITHDRAWAL:

  1. The BUYER has the right to withdraw from the contract, rejecting the product they purchased without assuming any legal or criminal liability and without any reason, within 14 (fourteen) days from the date of delivery to them or the person/institution at the address they indicated, provided that they notify the SELLER through the contact information below.

PERIOD OF THE RIGHT OF WITHDRAWAL:

​

  1. For the buyer, if what they purchased is a service, this 14-day period starts from the date the contract is signed. In service contracts where the service is initiated with the consumer's approval before the expiration of the right of withdrawal period, the right to withdraw cannot be used.

  2. Costs arising from the use of the right of withdrawal are borne by the SELLER.

  3. To exercise the right of withdrawal, a written notification must be made to the SELLER by registered mail, fax, or email within 14 (fourteen) days, and the product must not have been used in accordance with the provisions set out in the "Products That Cannot Be Withdrawn" clause of this contract.

 

USE OF THE RIGHT OF WITHDRAWAL:

​

  1. The invoice for the product delivered to the third party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution. Order returns invoiced on behalf of institutions will not be completed unless a RETURN INVOICE is issued.)

  2. Return form, the box, packaging, and, if available, standard accessories of the products to be returned must be delivered intact and undamaged.

RETURN CONDITIONS:

​

  1. Upon receiving the notice of withdrawal, the SELLER is obliged to return the total amount and documents that put the BUYER under obligation to the BUYER within a maximum of 10 days and to take back the goods within 20 days.

  2. If there is a decrease in the value of the goods due to a fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the goods or product during the withdrawal period.

  3. If the use of the right of withdrawal results in falling below the campaign limit amount set by the SELLER, the discount amount benefited within the campaign is canceled.

PRODUCTS THAT CANNOT BE WITHDRAWN:

​

  1. Goods prepared in line with the wishes or clearly personal needs of the BUYER and unsuitable for return, underwear, swimsuit bottoms, makeup materials, disposable products, goods at risk of rapid deterioration or with the possibility of exceeding the expiration date, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery, products mixed with other products after delivery and are impossible to separate by nature, goods related to periodic publications such as newspapers and magazines outside of subscription agreements, services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and the return of sound or video recordings, books, digital content, software programs, data recording and storage devices, computer consumables, whose packaging has been opened by the BUYER, is not possible as per the Regulation. Also, it is not possible to use the right of withdrawal for services that began execution with the consumer's approval before the end of the withdrawal period, as per the Regulation.

  2. For cosmetics and personal care products, underwear, swimsuits, books, copyable software and programs, DVDs, VCDs, CDs, and tapes, as well as stationery consumables (toner, cartridge, ribbon, etc.), to be returned, their packaging must not have been opened, tested, damaged, or used.

DEFAULT AND LEGAL CONSEQUENCES

​

  1. In the event the BUYER defaults when making payment transactions with a credit card, they accept, declare, and commit to paying interest within the framework of the credit card agreement between them and the issuing bank and will be liable to the bank. In this case, the relevant bank can resort to legal means; may demand the arising expenses and attorney fees from the BUYER, and under all circumstances, if the BUYER defaults due to their debt, they accept to compensate the SELLER for damages and losses incurred due to the delayed performance of the debt.
